Cases Filed Against Members and Officers
IPP Bro Rod Mapoy asked Bro Luis Paredes how administrative
cases should be handled in accordance with the Code of By-Laws.
Bro Luis Paredes stated
basically, the disciplinary functions of the organization has been transferred
from the Board of Directors to the Supreme Adjudicatory Council or to the
Regional Adjudicatory Councils. He said
that disciplinary actions or administrative sanctions can be divided into two.
First, those issues or controversies regarding
violations of the Code of By-Laws or regulations issued by the Board by
members. The procedure is to file the
complaint with the CoMe or directly to the SAC which will be referred back to
the CoMe because it will be subject to preliminary investigation by the
CoMe. The CoMe, after conducting preliminary
investigation, has no authority to impose any sanction against any member. However, it can make its recommendation and
forward this to the RAC if it concerns a Regional Officer or an ordinary member
or to the SAC if it involves a National Officer. The SAC shall decide upon
inter-regional disputes. After reviewing
the case, it is only the SAC that has the authority to suspend. It has no authority to expel or remove the
name of the member from the roster because, under the corporation code, it is
vested upon the stockholders or the general membership that can remove any
member.
Second, on questions regarding
the membership of alleged Brods and Sis.
The Commission on Membership has the authority to determine whether or
not a person is a member in accordance with the Code of By-Laws. The authority of the SAC or the RAC in such
issues is only as an appellate body or only to study whether or not the action
taken by the CoMe was right or wrong.
The decision of the SAC is final and not subject to review of the
General Assembly.
IPP Bro Rod Mapoy asked, Does the Board of
Directors have the power to suspend a member?
Not preventive suspension but suspension.
Bro Luis Paredes clarified that preventive
suspension is not a penalty but only a remedial action to protect the interest
of the organization. Thus, a preventive
suspension must have a definite time-frame and could not be indefinite.
In the case of Theta that was raised by Sis
Luvie Lumang, NP Bro Jimmy de Castro said that the Executive Council has a
dilemma because the lawyer of those alleged to have been involved is the
Regional Adjudicator himself.
After a thorough off the record discussion,
Bro Luis Paredes concluded that the suspension of Theta has automatically been
lifted and no amendatory resolution is needed.
